Judge declares mistrial in Mark Redwine case, trial to be rescheduled later this week

LA PLATA COUNTY — The judge in the murder trial for the La Plata County father accused in the death of his 13-year-old son declared a mistrial Monday.

Mark Redwine was arrested in Washington state and indicted in 2017 on charges of second-degree murder and child abuse resulting in death in the 2012 murder of Dylan, his son, in La Plata County.

During a status conference Monday,the District Attorney "made allegations concerning recent behavior of one of Mr. Redwine's attorneys and the contents of a telephone call made from the La Plata County Jail." As a result, the court declared a mistrial in the event the allegations are true and to ensure Redwine has "effective assistance of counsel."

Dylan’s remains were found in a remote area northwest of his father’s home near Vallecito Reservoir in May 2013. Investigators said DNA evidence taken from the father’s home and truck tied him to the murder. An autopsy found there was evidence of blunt force trauma on Dylan's body.

The indictment alleges the father and son had several disagreements before and during a court-ordered visit in 2012. The arguments centered on a custody dispute between his parents and reportedly disturbing and compromising photos of his father.

The trial will be rescheduled Friday, Nov. 13, at 11 a.m.
