El Paso Co. votes to establish committee to determine indemnification of Sheriff's Office employees

EL PASO COUNTY — The El Paso County Board of Commissioners voted unanimously Tuesday to establish a committee to determine indemnifications of sworn employees of the El Paso County Sheriff's Office in certain civil actions.

This action comes after Gov. Polis signed Senate Bill 217, which says that the employer of a local law enforcement officer can determine whether the deputy or officer acted in good faith in a use of force incident. If the individual is determined to not have acted in good faith, the officer is personally liable for five percent of the judgment of $25,000, whichever is less.

A proposed board would then make the decision if the officer would be protected.

The committee board would be made up of one member from the Sheriff's Office, the County Attorney's Office, the County Administrator's Office, and the Human Resources and Risk Management Office.
