New allegations surface in cadet sexual assault trial

COLORADO SPRINGS – An Air Force Academy cadet is facing court-martial on new charges of sexual assault.

The Air Force Academy is reporting Cadet 2nd Class Armis J. Sunday is facing two counts of violating Article 120, the allegations include sexual assault on a victim who was incapable of consenting due to impairment by alcohol and wrongfully photographing and distributing photographs of another’s private area.

The court-martial will get underway on Oct. 9th. This case started in July when Cadet Sunday underwent an Article 32 hearing on sexual assault charges.

The charge was referred to a General Court Martial and his arraignment was scheduled for Tuesday, however, the new allegations came to light after the fact, changing the nature of the hearing.

Whether the new charges will be referred to the scheduled trial in January will be determined after next week’s Article 32 hearing.

In the military court, an Article 32 hearing is similar to a grand jury proceeding to determine if probable cause exists to support the charges.
