City of Fountain settles wrongful death lawsuit

FOUNTAIN – The City of Fountain announced it settled a wrongful death lawsuit tied to a 2015 officer-involved shooting Thursday.

The city settled the case for $450,000 instead of pursuing further litigation. The city told News 5 it was not admitting guilt by settling the case, but decided to settle instead of pursuing further litigation.

A statement from the City of Fountain read, in part:

“During civil mediation proceedings, which are common for government agencies involved in these types of incidents, a settlement was reached. Out of compassion, dignity and respect for all persons involved in this difficult matter, the City of Fountain wants to honor the expectations and agreements reached in the settlement.”

The District Attorney’s Office ruled that the shooting that killed 17-year-old Patrick O’Grady was justified.

O’Grady’s mother sued the city and Corporal Jonathan Kay, the officer involved in the shooting.
