A daycare provider in Fremont County has been charged with Felony Child Abuse after a child died in her backyard last month.

Leslie Grayson, 52, turned herself in yesterday.  She's charged with one count of Felony Child Abuse, and six counts of Misdemeanor Child Abuse.  She was released on $15,000 bail. 

Grayson was caring for several children at her home on August 15, in the Lincoln Park area of Canon City when 4-year-old Riddick Boling drowned in Grayson's backyard swimming pool.

CAÑON CITY - It was noon at Leslie Grayson's home when the unthinkable happened. A four-year-old boy, Riddick Boling, was swimming in her pool when he suddenly stopped breathing.

Grayson, a license home daycare provider, called 911 and began CPR on the child. Paramedics rushed Boling to the hospital but doctors weren't able to save him.

Cpt. Don Pinover of the Fremont County Sheriff's Office says their investigators are treating the case as an accidental drowning.

"It's our understanding that he was playing in the pool with some other children and that the daycare provider heard some yelling, ran to the pool and the other children had actually, were in the process of pulling the boy out of the pool at that time," Pinover said.

News 5 searched Grayson's daycare license and found no record a pool listed on the property despite a state inspection there on September 21, 2011.

What's more, Grayson would have been required install a five foot fence with a locked gate around the pool. In order for the children to be swimming, she needed to have CPR training and permission from parents.

"From what we understand, it wasn't a case to where, like I say, he climbed over a railing or got through an unlocked gate," Pinover said. "It sounds like the kids were actually playing in the pool."

Grayson is cooperating with detectives and Pinover says it's too soon to say whether charges, if any, will be filed. However, he reminds all parents to be cautious with their children around the water.
