Swink school threat suspects to be formally charged

The three juvenile suspects accused of making threats against Swink school will be in court Tuesday afternoon for a formal reading of charges. News 5 is told an attorney for one of the suspects is expected to file a motion to close the courtroom to the public during proceedings.

The reading of formal charges was waived in court Tuesday, a pre-trial publicity order was ordered. This prevents any law enforcement and court personnel from talking about any details of the case. News 5 was told this was put in place after an attorney discovered social media posts targeting the juveniles.

The court did not rule on closing the court room in this case. The juveniles were formally charged with three counts of Conspiracy to Commit First Degree Murder and Interference with a School. 

Authorities took the suspects into custody on the morning of November 13th after a 'kill list' of 42 names was found inside in a La Junta park gazebo. The Otero County Sheriff's Office says there were 42 names in the list, including teachers, students, staff and family members.

The juveniles were released on bond. 

Under bond conditions the suspects are not allowed to own or use any kind of weapon, must consent to and wear ankle monitors, are not allowed to attend Swink school and are not allowed to contact each other.

The sheriff's office received several calls to complain about the juveniles being outside their homes while out on bond. Authorities had to clarify that the suspects were not under house arrest. 

The juveniles next court appearance is on Jan 5, for a pre-trial and motions hearing.
