It's been a year since 23 year-old Jesse Garcia was shot and killed by 80 year-old Jack Rogers in the Taco Bell parking lot on South Nevada.

No charges were filed against Rogers. The shooting was deemed self defense after the District Attorney reviewed surveillance video that's never been released to the public.

A year later a rally is held downtown on the steps of City Hall. 

Garcia was shot after an altercation with Rogers outside the South Nevada Taco Bell. The shooting followed a road rage incident according to police reports, but without Garcia's side of the story friends and family still think there's more that can be done.

A year later people are still calling for justice, they say not just for Jesse Garcia, "We're here for Jesse Garcia but we're also here for all the other black lives that have been taken where justice has not been served," said Olivia Romero who started 'Justice 4 Jesse.'

July 2016, Jesse Garcia is shot by 80 year old Jack Rogers. News 5 Investigative Reporter Andy Koen found out the two men knew each other. Garcia's grandmother lived across the street from Rogers and neighbors said Rogers kept close tabs on people's tags.

"Jack has several boxes.. boxes of notebooks of every vehicle that goes up and down this whole street," said Rogers' neighbor Nick Kufalk, "If they're parked he already has their license plate numbers down, everything."

Police reports say Garcia and Rogers got in a road rage incident leaving the neighborhood. Documents show Garcia had previously punched a person in the face in a separate road rage incident in 2015.

After the road rage incident the two men stopped in the Taco Bell parking lot. In August 2016 District Attorney Dan May says surveillance video shows Garcia approaching Rogers vehicle, reaching in, fighting for Rogers gun before it went off, killing Garcia.

"Obviously Jesse is deceased at this point so we can't hear what he has to say," May told News 5 in August 2016, "We can see his physical actions, we can see a lot of it on film. Clearly in this case we determined that no charges will be brought"

Almost a year after that decision people are still pushing the DA.

"It's wrong that that decision was made so quickly and that it was made behind closed doors," said Romero.  

The surveillance video has never been released, Garcia's friends think there's still enough evidence without it.

"Even if we don't have the tape. The Police Department did a good job about their investigation and even the crime report, you would have brought charges from it," said Garcia's friend Alma Robinson.
