District Attorney: Charges dismissed in fatal pedestrian accident

COLORADO SPRINGS -

The 4th Judicial District announced late Wednesday afternoon that the driver who struck and killed a pedestrian while backing into a parking spot on North Tejon Street will not be charged after all. Earlier in the day, police stated Trevor Dierdorff  was accused of a misdemeanor traffic offense.

According to Colorado Springs Police, Dierdorff backed into Mel Tolbert on the morning of March 28th.  Tolbert was not in a crosswalk as he crossed Tejon near E. Boulder Street.

Tolbert, the owner of Platte Floral, died from his injuries a few days later.

The District Attorney's office release cites Colorado law in stating it is not illegal to drive a car in reverse on a roadway, plus Tolbert was not in crosswalk at the time of the accident.

According to the District Attorney, Dierdorff checked his rear camera, but did not see Tolbert when he started backing up.

Dierdorff is the GOP Chairman for El Paso County. The charges of with misdemeanor careless driving causing death and the traffic infraction of Drivers to Exercise Due Care will be dismissed.
