Ruling on Tancredo's candidacy expected Tuesday

American Constitution Party gubernatorial candidate Tom Tancredo told a Denver judge that his party's bylines trumped state law when he got his last-minute nomination in July.

The former Republican congressman was responding Monday to a lawsuit filed by two Republicans who claim Tancredo violated state law when he got the American Constitution Party's nomination because he was not registered with the them for at least 12 months.

Republican voters Joe Harrington and Marian Olson say the third party is interfering in the election process and could create confusion and chaos in the November election because of last-minute changes to the ballot.

A ruling is expected Tuesday.
