A security guard who shot and a killed a man in Pueblo has pleaded guilty.
District Attorney Bill Thiebaut says last week David Noriega pleaded guilty to criminally negligent homicide. Noriega faces up to six years in prison.
The shooting happened in September 2008 at American Iron and Metal on Santa Fe Dr. Noriega claims he shot Clay Eldred after he and another person tried to get inside the scrap yard late at night. Eldred died.
Thiebaut says deadly force cannot be used to chase someone off a business property except when there's a threat of violence.
Noriega will be sentenced in February.
