SAN DIEGO (AP) - A Camp Pendleton Marine convicted of murder in an Iraq war crime has turned down an offer to be released from prison to attend the birth of his second child.

A Marine spokesman tells the North County Times that Sgt. Lawrence Hutchins III and his family decided against it because they did not want his 7-year-old daughter to see him in restraints.

Hutchins' wife, Reyna, gave birth to a son Monday at Naval Hospital Camp Pendleton.

Hutchins was convicted of leading an eight-man squad that kidnapped an Iraqi man, marched him into a ditch and killed him in 2006. He was sentenced to 11 years in prison.

The other defendants were released as a result of plea deals or decisions that sentenced them to time served.
