Marijuana patient denied seized pot despite court order

To local cancer patient Bob Crouse, the language of the Colorado's medical marijuana amendment is clear. It says any amount of the drug or associated paraphernalia seized by law enforcement shall be immediately returned upon acquittal.
Bob was arrested in 2011 and acquitted this past June. Yet the police still have more than 50 marijuana plants and about 6 pound of refined marijuana that were taken as evidence during his arrest.
The order, signed by District Court Judge Timothy Schutz, gives the department 10 days to comply.
Lee Richards, a spokesperson for the 4th Judicial District Attorney's Office tells News 5 that CSPD has requested they send the order to their appellate attorney for review.
