The El Paso County District Attorney's Office has ruled no charges will be filed in a shooting that happened on June 19, 2010, though two men will be charged with an incident that happened the previous day.
Douglas Hamilton of 603 Winnepeg Drive reported two men, Cory Juniel and Jason Wallace, approached his home around 1 p.m. and kicked in the door. According to the investigation, Hamilton shot Cory Juniel. Juniel and Wallace then ran out the door. Wallace took Juniel to Memorial Hospital where Juniel died.
The District Attorney's report indicates Hamilton was justified in the shooting because he was acting to protect himself from a physical threat.
However Hamilton will be charged in an incident that happened the previous day when three juveniles apparently broke into his home and took some computer equipment. According to the police report, Hamilton's roommate, Kirby Braithwaite was able to catch one of the suspects. The report says Braithwaite and Hamilton assaulted and threatened the juvenile until the stolen items were returned.
Juniel was related to the juvenile and according to the report, and came to Hamilton's house seeking revenge the next day.
Hamilton, 64, and Braithwaite, 25, will be charged with 2nd degree kidnapping and 3rd degree assault on the juvenile.
