LONGMONT, Colo. (AP) - A judge says a lawsuit that state regulators filed seeking to strike down some of Longmont's new oil and gas drilling rules can proceed.
The Times-Call reports (http://bit.ly/UqMyTN ) a Boulder District Court judge on Tuesday denied the city's request to dismiss the lawsuit. The judge also ruled that the Colorado Oil and Gas Association trade group can join the suit, which was filed by the Colorado Oil and Gas Conservation Commission.
State regulators say the drilling rules that the City Council passed July 17 regulate areas that are meant to be governed by the state. City officials contend the rules fall within Longmont's land-use authority.
