Fountain medical marijuana feud headed to court

This week, a Fountain city councilmember and a former councilmember will go head to head in court.  The fight is about a restraining order, but the battle is about medical marijuana. 

Al lender says he wants to be a grower for a Colorado Springs dispensary.  Fountain's new medical marijuana city ordinance doesn't allow him to do that.  He admits he got mad and had some choice words for councilmembers Lois Landgraf and Harold Thompson back on June 8.

"I thought this was the greatest opportunity, and then the roof caves in on me," says Lender.

Lender and Thompson were involved in a physical scuffle.  The appointed District Attorney from Canon City says Thompson won't face criminal charges for the fight.

Both Thompson and Landgraf have filed restraining orders against Lender.

In an email to News First 5 Landgraf says, "Mr. Lender's aggressive demeanor, his confrontational behavior and his language toward both Mr. Thompson and myself were completely inappropriate. Mr. Lender's behavior should not be condoned by anyone."

"A lot of people won't show up and speak up about it because they're afraid of exactly this," says Lender.

Lender says he's waiting for his time in court, and hoping for a change of heart in the future about his medical marijuana business.

News First 5 made several attempts to speak with Thompson, but have not received any word back from him.
