Dunlap attorneys challenge robbery conviction

DENVER (AP) - Attorneys for death row inmate Nathan Dunlap are challenging a robbery conviction prosecutors used to get the death penalty.

The attorneys filed a motion in federal court Thursday saying Dunlap did not get a fair trial on the robbery charges because of publicity over the murder charges.

Dunlap was sentenced to death after he was convicted of killing three teenagers and a mother of two at a Chuck E. Cheese restaurant in 1993.

According to the Denver Post, Dunlap's defense team hopes by taking that block out the death penalty foundation the death sentence could be challenged.

An attorney for the state says the robbery conviction did not taint the murder trial.
