Denver homicide suspect who ate pot due in court

DENVER (AP) - A man whose wife told Denver 911 dispatchers he ate marijuana-infused candy before he fatally shot her is expected in court.

A preliminary hearing is scheduled Friday for 48-year-old Richard Kirk, who is charged with first-degree murder in the April 14 killing of 44-year-old Kristine Kirk.

Authorities say she told dispatchers her husband ate the marijuana candy and may have also taken prescription pain pills before he started hallucinating and frightening their three children. Police have not said whether they believe the marijuana influenced his behavior.

Authorities say dispatchers heard a gunshot nearly 13 minutes into the 911 call. Police have blamed their delayed response on a dispatcher who failed to relay information to officers about the gravity of the situation.

Attorneys for Kirk have declined to comment.
