CASTLE ROCK, Colo. (AP) - An inmate accused in the 2002 slaying of a prison worker will be placed on trial and prosecutors will seek the death penalty.
Douglas County District Court Judge Richard B. Caschette Tuesday allowed inmate Edward Montour to withdraw his guilty plea in the death of 23-year-old Eric Autobee.
Montour pleaded guilty in January 2003 in the death of Autobee at Limon Correctional Facility about 75 miles southeast of Denver.
A judge previously sentenced Montour to death but that was overturned by the Colorado Supreme Court because it was handed down by a judge, not a jury.
