DENVER (AP) - Colorado Attorney General John Suthers says Republican Colorado Secretary of State Scott Gessler is justified hiring an attorney in a court battle trying to force Gov. John Hickenlooper to set election dates in the recall elections of two Democratic state lawmakers.
According to the Denver Post, Suthers said Tuesday his office recommended Gessler hire outside counsel because the attorney general represents both the secretary of state and governor in a court challenge where attorneys are trying to stop the recall elections.
Gessler claims Hickenlooper, a Democrat, is required to set a date for recall elections of Senate President John Morse, D-Colorado Springs, and Sen. Angela Giron, D-Pueblo.
Hickenlooper is waiting on a court hearing Wednesday seeking an injunction until confusion over state law can be settled.
