City agrees to pay $95,000 to settle excessive force claim

The City of Pueblo has agreed to authorize a $95,000 payment to a man who claimed excessive force was used when he was arrested in April of 2011 in the parking lot of the Sunset Inn.

The city admitted no wrongdoing. The money will come from the Colorado Intergovernmental Risk Sharing Agency.

Nick Falletta was beaten and knocked to the ground, tased and arrested by Officers Derek Wyberg and Antoinette Ramos. Charges against him were eventually dropped.

Falletta's attorney said the incident happened when Falletta demanded that Wyberg stop bothering his friends. Wyberg apparently had an interest in an ex-girlfriend of one of Falletta's friends. Wyberg was later suspended for 5 days. He also faces several misdemeanor charges which are still in the courts.
