SAN DIEGO (AP) - A 92-year-old woman who sold $40 kits for people to kill themselves is being sentenced in San Diego for failing to file federal tax returns.

Prosecutors recommend that Sharlotte Hydorn be ordered to pay more than $25,000 in restitution to the Internal Revenue Service Monday and be sentenced to five years' probation. Her attorney says she only get five years' probation.

The retired school teacher admits she sold the helium kits intended for terminally ill customers.

Court documents say she sold more than 1,300 kits to people across the United States and abroad. Most contacted her by mail or phone.

Hydorn pleaded guilty to the tax charge in December. Under an agreement with prosecutors, she will not be in charged in state court with involvement in six suicides.
