El Paso County to sue developer

El Paso County is suing a local developer that didn't make good on his word.  Commissioners say the developer of the Falcon Heights Subdivision agreed to paving the roads and putting in drains, but hasn't. 

"It is a nice place to live,” said Robert Reskey who has lived in the subdivision for two years.  “We have really great neighbors. It's very comfortable here, but the only problem is we don't have roads and we don't have good drainage,”

 The roads in the development are unpaved, and Reskey says it's a bumpy ride that only gets worse when it rains and they fill with water. He says the homeowners were promised paved roads and working drains by the developer.

 “We have it in black and white,” he said. “Every time somebody has purchased the house, they've given you a different date of when they would go in.”

The development is northeast of the intersection of Highway 24 and Woodmen Road, and has 98 lots.  The developer, Falcon Heights Development Corporation, is being sued by El PasoCounty along with three people involved with the business. And the county says, the company that issued the bond doesn't have the money to pay for the roads either.

In a statement, El Paso County Commissioner Dennis Hisey said, “It is not a good situation to be in, but I feel that the CountyAttorney's office will make the most of it and help the residents get what was promised to them."

“I've never received anything officially in the mail or they've never contacted me,” said Jack Pfost, one of the three people the county is planning to sue. He claims he knew nothing about the problems until today, and also claims he gave money to get the business started several years ago, but isn’t involved anymore. 

“As far as I know, the development they're not doing anymore building on there,” he said.

News First tried to reach the other two people, Connie and Tom Pfost. We couldn’t reach Tom, and Connie said she wanted to speak to her lawyer before doing an interview with us.
